Houston Appeals Court Overturns $73 Million Train Injury Award, Orders New Trial

According to the pleadings, the plaintiff fell asleep on Union Pacific Railroad tracks on March 5, 2016, and was struck by a train. Following a jury trial, judgment was entered in her favor for $73 million. The First Court of Appeals reversed the judgment and ordered a new trial, finding that the jury was instructed under an ordinary negligence standard when the correct standard for a trespasser was gross negligence.
